The Morocco Ministry of Trade, Industry and Energy has issued Act 24-09 on product and service safety to protect users of industrial products in the Moroccan market.

The goals of the law are to:

    – Prevention of accidents related to product use

    – Consumer confidence guaranteed

    – Strengthening the responsibilities of economic operators

    – Strengthen market surveilance

    – Comply with current regulations

    – Bringing Moroccan law closer to international practice

    – Promote compensation for victims of dangerous products

This law, which establishes the obligation for an importer or manufacturer to label products, is valid for three categories of products:

    – Electrical equipment designed for use within certain voltage limits

    – Equipment affected by electromagnetic compatibility

    – Toy

The above mentioned product category must meet the requirements of the relevant national technical regulations of Morocco before the attachment of C م , and if the product meets the technical regulatory requirements, the manufacturer shall determine the suitability provided by the specific technical regulations for which the product applies to that product. You must create a declaration.

This declaration of conformity must include:

    –  Product Identification Information

    –  Manufacturer’s name and address

    –  See applicable standards

The Declaration of Conformity must be provided and available to the competent authority for at least 10 years upon request.

Taking into account the fact that foreign manufacturers cannot attach a conformity mark immediately, they decided not to control the existence of the mark until November 20201. However, the manufacturer must undertake the marking procedure.

If the prouduct does not meet the relevant requirements, it is strictly forbidden to attach the mark. In addition, the following sanctions may apply if autorities find products that do not comply with regulations during market surveilance.

    – 3 months to 2 years imprisonment and a fine of 50,000 to 1,000,000 Dh (approximately 5,000 to 100,000 USD)

    – Make sure that the vertical dimension of the letter “C” is 6mm or more when attaching a conformity mark to the product.

    – This mark must be clearly and indelibly attached to the electrical and electronic products or their data plates.
