The UAE government has established regulations on product safety to improve producy quality.
The Product Safety Act consists of the provisions of Article 21, which applies to products that can be used or reasonably used by consumers, whether the product is new or used.
In this regulation, “product” is defined as the final form of product that can be used or used by consumers.
The Product Safety Act came into force on 1 July 2019 and the following products are exempt from scope.
– Medicines and veterinary medicines, vaccines, serums, and similar products
– Antiques
– Used products that need to be repaired, rehabilitated or modified during the period prior to placement on the market
The supplier must ensure that the product complies with ESMA or the applicable standard for that product.
This provision applies to companies in the product supply chain that are manufactured within, or imported into, the UAE, including manufacturers, agents, distributors, and importers (collectively “Suppliers”).
Suppliers must comply with the following regulations.
– ensure that products placed on the market are safe
– take all necessary preventive measures (to be further determined by way of regulation) to identify any risks or issues arising from a product’s use in the supply chain so that corrective action can be taken.
